1. GENERAL 

1.1. Application: Simple terms and conditions apply in our commercial relations. By placing an order, the buyer acknowledges that he has read and approved our general terms and conditions. any deviations, even if stated on the purchaser's order form, are only applicable if subject to a written agreement from us. Even in that case, the present conditions will continue to apply for all points that have not been expressly deviated from.

1.2. Jurisdiction of the courts: Only Belgian law applies to all contracts entered into by N.V. Future Living. Only the Courts of Hasselt - Hasselt division - or Tongeren - Tongeren division - are competent for all disputes, at the discretion of Future Living.

2. PRICES, QUOTES AND ORDERS

2.1. Prices: Our prices are net and exclusive of VAT. All taxes, duties and costs, and in particular the costs mentioned below, are borne by the buyer

2.2. Quotations: Prices are only binding by written confirmation from us. The validity of the offers is limited to 30 days, unless stated otherwise. Our price offers are based on the copper exchange rate and rates applicable at that time. We reserve the right to adjust the prices to the prevailing copper exchange rate & rates on the date of the order, as well as to correct material errors, calculation or printing errors.

2.3. Orders: The buyer is irrevocably bound by his order, but we only guarantee this after written confirmation from us. Future Living reserves the right to cancel, suspend or only partially execute the order at any time without any compensation or recourse for the customer. At the request of the customer, Future Living reserves the right to cancel the order subject to compensation determined by Future Living.

3. DELIVERIES

3.1. Risk: The goods are always sent at the risk of the buyer, even if the delivery is managed , executed or paid by us.

3.2. Delivery time: The delivery times are given for information only and are not binding on the seller. Delays do not entitle you to compensation or cancellation of the order.

3.3. Shipping costs: Deliveries in Belgium and the Netherlands for an amount higher than 300 EUR are free of charge. Unless stipulated otherwise, a flat-rate intervention of at least 19 EUR transport costs will be charged for any other delivery.

3.4. Invoicing: Unless otherwise stipulated, invoicing takes place on the date the material is made available. The storage of the goods is at the buyer's risk from the date the material is made available. If the buyer does not collect or receive the goods within a period of 10 working days after they have been made available, Future Living may cancel the order without any compensation.

4. RETURNS

4.1. Goods sold are neither taken back nor exchanged. Subject to prior written agreement, this can be deviated from. In that case, a reduction is applied for administrative costs with a minimum of 55 EUR. The return and carriage payment must be made by and is at the expense of the buyer.

5. ENVIRONMENTAL CONTRIBUTION

5.1. An environmental contribution will be charged on the goods concerned and according to the rates currently in force at RECUPEL, PV CYCLE BELGIUM and any other recognized body. No discount can be granted on the environmental contributions transferred by Future Living.

6. COMPLAINTS AND WARRANTY

6.1. Complaints: All complaints in connection with the delivery or with the invoice must be reported to us in writing, under penalty of forfeiture, within eight days of the date of receipt of the goods or date of the invoice. The goods that are the subject of a complaint must remain at our disposal for inspection; they will be presumed to have been accepted by the customer if they are no longer recognizable or have already been processed.

6.2. Warranty: The product warranty is limited to the manufacturer's warranty and its term starts when the product is made available. Our responsibility is limited to the warranty of the product. Our responsibility is in any case limited to the value of the goods. Under no circumstances will we be held responsible for indirect or incidental damage or damage caused by misuse.

6.3. Our advice and studies remain for information purposes, without any commitment or responsibility on our part.

7. PAYMENTS

7.1. Payment term: All invoices are payable in cash via the shop, unless otherwise agreed. If a payment’s due date is exceeded, all invoices (whether or not expired) of the customer can become due and payable. In the event of non-payment, we reserve the right to discontinue further deliveries, performances & services and to regard the agreement as dissolved by operation of law and without prior notice of default for the whole or the part that has not yet been performed.

7.2. Interest: In the event of non-payment of the invoice within the stipulated period, conventional interests are due by operation of law and without prior notice of default, cf. the Act of 2 August 2002 on late payment in commercial transactions, to be calculated from the due date of the invoice until the date of receipt. of the payment.

7.3. Compensation: In the event of non-payment on the due date, the invoice amount will automatically and without notice of default be increased by 15%, with a minimum of EUR 50 and a maximum of EUR 5,000, by way of a conventional compensation clause as a fixed compensation for extrajudicial costs, without prejudice to the court costs and on top of the default interest.

7.4. The allocation of payments: according to art. 1254 of the Civil Code.

8. RETENTION OF TITLE

8.1 The goods remain the property of the seller until full payment has been received. The goods subject to retention of title can only be resold in the context of normal business operations. In the event of resale, the buyer is in turn obliged to stipulate a valid and opposable retention of title on the resold goods in favor of Future Living.

9. COMPENSATION

9.1 The compensation of existing debts and claims between buyer and seller takes place by operation of law.
